The candidates’ answers showed that they understood the scenario in the case study. Most of the candidates answered some part of the questions very well. Although none of the candidates were able to answer correctly the class of motor insurance policy that a construction company would require to cover equipment at the construction site.

  1. What was the proximate cause of the accident?
  2. Who was at fault?
  3. Which policies will cover the accident involving the driver of the oncoming vehicle;

 (ii)injured site worker;
(iii) damage to Mr Olu’s vehicle.
(d)   Identify the class of motor insurance policy that West construction Company would require for their equipment at the site.

 

Observation


1 (a)The proximate cause of the accident was the heap of sand on the road.

(b)(i) Mr. Olu, the driver of the oncoming vehicle was at fault
  (ii)The driver was at fault because he failed to observe the warning sign displayed by the construction company.
(c)(i) The accident involving the driver of the oncoming vehicle could be covered by
Personal accident insurance policy     

  • The policies that would cover the injured site worker are:
  • Employers’ liability insurance or Employees Compensation Scheme or Workmen’s compensation;
  • Group personal accident insurance;
  • Third party liability section of Mr. Olu’s Motor Policy.
